Terms of Use

1. Acceptance of Terms

By downloading, installing, or using TERMINUS - THE LINE, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the app.

If you use the app on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. What the App Provides

TERMINUS - THE LINE is scenario-based training software. It provides short first-person AI-generated scenarios, decision scoring, reaction-time feedback, saved session data, and optional community insight features such as voting and comments.

Scenario content is synthetic simulation content. It is not presented as footage of actual incidents.

The app is for simulation and skill development. It is not legal advice, law enforcement advice, emergency dispatch, medical guidance, or real-time tactical direction.

3. Eligibility and Account Responsibility

  • You must be legally capable of entering a binding contract in your jurisdiction.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate account information and keep it up to date.
  • You must safeguard your credentials and notify support of suspected unauthorized access.

4. License Grant and Restrictions

Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to use the app for personal lawful use.

The app is licensed, not sold. If you downloaded the app from the App Store, your use must comply with Apple's usage rules and any applicable Apple Media Services terms.

You may not:

  • Copy, distribute, or resell the app or its content.
  • Reverse engineer, decompile, disassemble, or attempt to extract source code except where prohibited by law.
  • Circumvent security features or access controls, including subscription gates.
  • Use the app to create harmful, unlawful, or abusive content or workflows.

5. Safety-Critical Use Limits

You are solely responsible for your real-world conduct, legal compliance, and safety decisions. Training outcomes in the app do not guarantee real-world outcomes.

  • Do not use the app as a substitute for emergency services, professional instruction, or lawful judgment in live situations.
  • Do not use the app while driving, operating machinery, impaired, or in any unsafe condition.
  • If you use dry-fire tools or inert training props, you are responsible for following all applicable laws and strict safe handling practices.

6. Subscription, Trial, and Billing Terms

  • Trial access and paid features are described in-app and may change over time.
  • Paid access is offered through Apple In-App Purchase unless otherwise stated.
  • Auto-renewable subscriptions renew automatically unless canceled at least 24 hours before the current period ends.
  • Payment is charged by Apple to your Apple account at confirmation of purchase and at renewal.
  • You can manage or cancel subscriptions through your Apple account settings.
  • Refunds are handled by Apple under App Store rules and applicable law.
  • If required by law, Apple may request consent for certain pricing or term changes before renewal.

7. Community Features and User Content

If you submit comments, votes, or other community content, you remain responsible for what you post.

  • You grant us a worldwide, non-exclusive license to host, process, display, reproduce, and moderate submitted content to operate and improve the service.
  • If you explicitly opt in to detection-improvement sharing, you also grant us permission to use those short event-centered samples and their annotations to evaluate, train, and improve click-detection and posture/fusion systems.
  • You must not post unlawful, threatening, harassing, defamatory, obscene, hateful, or otherwise objectionable content.
  • We may remove, restrict, or moderate content at our discretion to protect users and service integrity.
  • You can report objectionable content at support@tmns.app.

8. Acceptable Use

You agree not to:

  • Use the app in violation of applicable laws or regulations.
  • Interfere with app performance, availability, or security.
  • Attempt unauthorized access to systems, APIs, accounts, or data.
  • Automate abusive requests or engage in behavior that harms other users.
  • Manipulate, scrape, or mine app content or analytics except through authorized features.
  • Upload content that promotes unlawful violence, encourages reckless behavior, or violates the rights of others.

9. Suspension and Termination

We may suspend or terminate access to the app at any time for misuse, legal compliance, safety concerns, non-payment, or violations of these Terms. You may stop using the app at any time.

10. Intellectual Property

The app, software, scenarios, visual assets, text, branding, and related materials are owned by us or our licensors and protected by intellectual property laws.

11. Feedback

If you provide feedback, suggestions, or feature ideas, you grant us a perpetual, worldwide, royalty-free right to use that feedback without restriction or compensation.

12. Third-Party Services and Terms

The app may rely on third-party services, including Apple services. Those services may have separate terms and policies that also apply to your use.

You agree to comply with applicable third-party agreements when using the app, including your wireless data service and platform provider terms.

13. Privacy

Your use of the app is also governed by our Privacy Policy.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the app is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business interruption arising out of or related to your use of the app.

16. Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, and agents from claims, liabilities, damages, and expenses arising from your misuse of the app, your content, or your violation of these Terms.

17. Export and Sanctions Compliance

You represent and warrant that you are not located in a country subject to U.S. embargo, and are not listed on any U.S. government prohibited or restricted-party list.

18. Apple App Store Additional Terms

  • These Terms are between you and 4cheese llc / Terminus Labs, not Apple.
  • Apple has no obligation to provide maintenance or support services for the app.
  • In the event of a failure of the app to conform to an applicable warranty, you may notify Apple for a refund of the purchase price, where applicable. To the maximum extent permitted by law, Apple's only warranty obligation is that refund.
  • We, not Apple, are responsible for addressing product claims, legal/regulatory compliance claims, privacy or consumer protection claims, and third-party intellectual property claims related to the app.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

19. Governing Law and Disputes

These Terms are governed by applicable laws of the United States, without regard to conflict-of-law principles, except where local law requires otherwise.

20. Changes to Terms

We may update these Terms from time to time. Updated Terms become effective when posted, and the Last Updated date will be revised.

21. Severability and Entire Agreement

If any part of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, form the entire agreement between you and us regarding use of the app.
